Terms of Service

1. What Winnie is

Winnie is an AI trip planner for India. You describe the trip you want; Winnie generates a day-by-day itinerary with suggested cities, stays, transport legs, experiences, and estimated INR costs. Winnie does NOT book flights, hotels, trains, or anything else. Bookings happen on third-party sites (Booking.com, Skyscanner, IRCTC, MakeMyTrip, RedBus) that we may deep-link to.

2. Free to use

The core Winnie planner is free. If we add premium features, they will be optional add-ons; the base planner will remain free. There are no ads or paywalls in the trip-planning flow today.

3. Eligibility

You must be at least 13 years old to use Winnie. If you are between 13 and 18, you must have permission from a parent or guardian. By signing in, you confirm you meet these requirements.

4. Your account

You can create an account with Google sign-in or with an Indian mobile number and name. Keep your login credentials safe; you are responsible for activity under your account. If you lose access, email hello@trywinnie.com.

5. India only

Winnie plans trips inside India only. If you ask for a non-India destination (Thailand, Bali, Dubai, Nepal, etc.), we will politely suggest Indian alternatives with a similar vibe. This is a product design choice: we would rather do one country very well than every country badly.

6. Accuracy: what to trust and what to verify

Winnie generates plans using AI and public data. We take accuracy seriously and validate the plan against real cost ranges, transport times, and destination catalogs. Even so, some things CAN and DO change:

• Prices are estimates. Live flight, hotel, and train fares are what the booking partner shows.
• Opening hours, permit rules, and closures (weekly holidays, festival closures, monsoon shutdowns) change without notice.
• Weather is a forecast; the sky does not read our itinerary.
• Currency exchange rates fluctuate. Winnie shows INR primarily; other currencies are indicative.

Please verify critical details (permit requirements, temple dress codes, medical needs, altitude precautions) with the source authority before you travel.

7. Acceptable use

You agree NOT to:

• Use Winnie to plan activities that are illegal in India or in your home country.
• Scrape, mirror, or resell Winnie's output as your own paid product.
• Attempt to reverse-engineer, disrupt, or overload the service (rate limits are enforced).
• Impersonate someone else or misrepresent your identity.
• Post content that is defamatory, harassing, hateful, or infringes intellectual property.
• Use Winnie to submit prompts that request illegal, harmful, or sexually explicit content about real people.

We may suspend or terminate accounts that violate these rules, without notice.

8. Bookings on partner sites

Winnie deep-links to third-party booking sites (Booking.com, Skyscanner, IRCTC, MakeMyTrip, RedBus, Google Flights). Any booking you make on those sites is a contract between YOU and that partner. Winnie is not a party to it. We do not guarantee their pricing, availability, cancellation policies, or service quality.

9. Intellectual property

The Winnie name, logo, product design, and blog content are owned by us. You may share screenshots of itineraries Winnie generates for you (please credit trywinnie.com). You may not reuse our brand, replicate the site, or reproduce our blog articles without written permission.

You retain ownership of the trip prompts you write. By using Winnie, you grant us a limited licence to store, process, and display those prompts and the resulting itineraries within the service, and to use them in aggregate, anonymised form to improve Winnie.

10. Warranties (or lack of them)

Winnie is provided as is and as available. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Winnie will be uninterrupted, error-free, or that every generated itinerary is perfectly accurate.

11. Limitation of liability

To the maximum extent allowed by law, Winnie and its team are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost trip opportunities, arising from your use of the service. Our total liability for any claim relating to Winnie will not exceed the amount you paid us in the 12 months before the claim, which for a free service is INR 0.

This limitation does not apply to liability that cannot be excluded under Indian law.

12. Indemnity

You agree to indemnify and hold Winnie harmless from any claim arising out of your misuse of the service, violation of these Terms, or infringement of another party's rights.

13. Suspension and termination

You can stop using Winnie at any time and request account deletion via hello@trywinnie.com. We may suspend or terminate access if you violate these Terms, abuse the service, or if we discontinue Winnie in whole or in part. Where reasonable, we will give notice before terminating.

14. Changes to the Terms

We may update these Terms as the product evolves. Material changes will be highlighted at the top of this page. Continued use of Winnie after an update means you accept the revised Terms.

15. Governing law and disputes

These Terms are governed by the laws of India. Any dispute will be resolved in the courts at Bengaluru, Karnataka, India, unless your local law grants you a specific right to bring it elsewhere.

16. Miscellaneous

• If any provision of these Terms is found unenforceable, the remaining provisions still apply.
• Our failure to enforce a right is not a waiver of that right.
• You may not assign these Terms without our written consent. We may assign them to an affiliate or acquirer.
